Fitzgerald Jones, at its discretion, may change, modify, and/or remove these terms and conditions at anytime and it is therefore important to read them each time you place an order. Please note that all the terms and conditions outlined in this page are created in accordance with Distance Selling Regulations and do not affect your statuary rights.
Please carefully read through all sections below. These terms may effect your return rights if needed.
6. Liability
6.1 If the buyer notices a defect they need to provide written notice of this to the seller within 72 hours of locating the defect. This will apply only to selected items. Please be mindful that most of the items on this site are from a pre-used back ground.
6.2 The seller is given reasonable opportunity after receiving the buyer's notice of the defect to examine the good(s) in question and the buyer, if asked, shall provide photographic evidence of the defect.
6.3 If buyer makes further use of the good(s) after giving notice of the defect to the seller then this will make the return agreement null and void.
6.4 If the defect arises as a result of wilful damage, negligence, misuse, abnormal working conditions or failure to follow oral or written instructions as to the storage of use of the good(s) this will make the return agreement null and void.
6.5 If the buyer alters or tries to repair the good(s) without obtaining permission from the seller and then wants to return the good(s) altering the good(s) will make the return agreement null and void.
6.6 If any good(s) are found to be defective, then within 24 hours from day of delivery, the Seller examining the defective good(s), the seller will repair or replace such Goods but only on selected items. We must be mindful that these items are from former use.
7. Damaged Good(s)
If damaged good(s) are delivered to the buyer, then the buyer is required to do the following;
7.1 Notify the seller and the carrier at the time of delivery;
7.2 Take photographic evidence of the damage or defect(s)
7.3 Send the photographic evidence to the Seller via email
Providing the buyer has adhered to clauses above the seller will:
7.4 Replace the damaged or defected good(s) within 1-14 working days if available, unless any reasons beyond the control of the seller prevent this.
8.0 Cancellation Rights
The Contract cannot be cancelled if:
8.1 Any of the good(s) ordered are custom built or made to order.
8.2 The good(s) have been used.
If the buyer wishes to cancel the contract before the good(s) have been delivered, then:
8.3 The buyer must inform the seller that they wish to cancel the contract.
The buyer does not need to give the seller any reason for cancelling the contract nor will the Buyer have to pay any kind of penalty. However, the buyer must notify the seller if they wish to cancel the contract. This can be exercised in writing or in another durable medium and:
8.4 Once the buyer has notified the seller that they wish to cancel the contract, any sum debited to the seller from the buyer's credit and/or debit card will be re-credited to their account as soon as possible and in any event within thirty (30) days of the order provided that the good(s) in question are returned to the address provided by the seller and in the same condition they were in when delivered. If the buyer does not return the Good(s) delivered to them, the seller will be entitled to deduct the direct costs of recovering the good(s) from the amount to be re-credited to the buyer. Returns from outside mainland UK will be charged at the costs applied for the outbound delivery.
8.5 The seller reserves the right to cancel the contract if one or more of the good(s) ordered was listed at an incorrect price or quantity due to a typographical error or an error in the information received by the seller from the supplier(s).
8.6 The buyer cannot cancel the contract once the good(s) have been in their possession for more than 7 days.
Online dispute resolution according to Act. 14 (1) Regulation on consumer ODR: The European Commission provides a platform for online dispute resolutions (ODR) which can be accessed under http://ec.europa.eu/consumers/odr/
All payments are to clear before items can be delivered or collected (please be aware that e-cheques through PayPal can take up to two weeks to clear).
If any item has been misdescribed and after negotiation the buyer feels aggrieved, return of the item will be accepted within 7 days of purchase and a full refund will be given providing the item(s) are returned as received.
Please note we cannot accept returns or refunds for international delivery in some cases nor on selected item show on the product pages
